O CONTEXTO DAS MUDANÇAS CLIMÁTICAS E AS SUAS VÍTIMAS /// \\\ THE CONTEXT OF CLIMATE CHANGES AND ITS VICTIMS
Abstract
As mudanças climáticas vêm causando uma crise múltipla na medida em que afetam os recursos naturais e o meio ambiente. Mas também produzem um impacto econômico que ainda não pode ser quantificado. Com efeito, a sociedade, pela primeira vez, confronta-se com um problema para o qual talvez não esteja preparada. Ademais, os resultados das mudanças climáticas na natureza geram consequências nas relações sociais, nos níveis populacionais, no estoque de alimentos, em novas doenças e expansão de algumas antigas, nos deslocamentos ambientais, enfim em temas que dificilmente seriam objeto de regulação. Não é mais permitido se classificarem todos os episódios climáticos extremos como meros “acasos naturais”, quando já se sabe que o seu agravamento é fruto sim da intervenção humana na natureza, implicando um risco existencial de proporções catastróficas, caso não seja alterado o quadro atual de degradação do ambiente. E o Direito é o instrumento de regulação das relações sociais capaz de ajustar a conduta, não só dos atores privados, mas também do Estado, a padrões ecologicamente sustentáveis e adequados à mitigação e adaptação às mudanças climáticas. Portanto, o objetivo desta pesquisa foi contextualizar as mudanças climáticas e identificar quais seriam as suas vítimas.

ABSTRACT
limate change are causing a crisis in that multiple affect natural resources and the environment. But also produce an economic impact can not yet be quantified. Indeed, the company, for the first time confronted with a problem which may not be prepared. Moreover, the results of climate change on nature have consequences in social relations, population levels in the food supply, new diseases and expansion of some old shifts in environmental finally on topics that would hardly be the object of regulation. Is no longer allowed to classify all extreme weather events as mere “natural hazards”, when you already know that your fruit is rather worsening human intervention in nature, implying an existential risk of catastrophic proportions, if not change the current situation of environmental degradation. And the law is the instrument for the regulation of social relationships able to adjust the behavior not only of private actors, but also the state standards ecologically sustainable and appropriate mitigation and adaptation to climate change. Therefore, the aim of this research was to contextualize climate change and identify what are their victims.

RÉSUMÉ
Les changements climatiques sont à l’origine d’une crise multiple dans la mesure où affecter les ressources naturelles et l’environnement. Mais aussi de produire un impact économique ne peut pas encore être quantifiée. En effet, la société pour la première fois, est confronté à un problème pour lequel ne peut être préparé. En outre, les résultats du changement climatique sur la nature génèrent des conséquences dans les relations sociales, les niveaux de population dans l’approvisionnement alimentaire, les maladies dans la nouvelle et l’expansion de certains anciens, sur les modifications de l’environnement, enfin, sur des questions qui ne serait guère l’objet d’une réglementation. Il est plus permis de classer tous les événements météorologiques extrêmes comme de simples «risques naturels» quand on sait que son aggravation est plutôt le résultat de l’intervention humaine dans la nature, ce qui implique un risque existentiel de proportions catastrophiques si le cadre actuel ne soit pas modifié dégradation de l’environnement. Et la loi est l’instrument de régulation des relations sociales capables d’ajuster la conduite non seulement des acteurs privés, mais aussi l’état, l’atténuation écologiquement durable et appropriée et l’adaptation aux normes du changement climatique. Par conséquent, l’objectif de cette recherche était de contextualiser le changement climatique et d’identifier leurs victimes seraient.
